Token qualification by assessing whether they can be defined as security tokens or utility tokens

Our colleagues Adina Ionescu and Simona-Daniela Chiperi wrote an analysis on the token qualification requirements in relation to the possibility of defining tokens as security or utility tokens, both in terms of European and US legislation.

As blockchain technology has become increasingly popular in recent years, beyond cryptocurrencies an array of cryptoassets have developed, many of them known as tokens. The correct classification of a token as a security token or utility token is not an easy task, and the legal consequences of doing so can be extremely significant.
